Terms of Service

Our standard package is priced at $999 AUD, payable as a one-time fee. Payment is due in full before design work commences unless an alternative arrangement has been agreed in writing.

• Payment is accepted via bank transfer, credit card, or other methods agreed at time of order
• Work will not begin until payment is confirmed
• All prices are in Australian Dollars (AUD) and inclusive of GST where applicable
• Additional services (extra pages, custom features) are invoiced separately

We aim to deliver your first draft website within 5 business days from the date we receive your completed onboarding brief and full payment.

• The timeline begins once your brief is received in full — incomplete briefs will delay the start date
• Delays caused by the client (e.g. late feedback, missing content, slow approval) will extend the delivery date accordingly
• We will communicate any delays promptly in writing
• Launch occurs within 48 hours of your final approval

We do not guarantee specific delivery dates for custom or out-of-scope requests. These are agreed separately in writing.

The standard package includes one round of revisions following delivery of the first draft. A revision round is defined as a consolidated set of changes submitted in a single communication.

• Revisions must be submitted within 7 days of receiving the draft link
• Additional revision rounds beyond the included one may be charged at an hourly rate agreed in writing
• Major changes to scope, layout, or concept after the first draft has been delivered are considered out-of-scope work
• Your written approval (email or message) is required before the site goes live

We stand behind our work. However, our refund policy is clearly structured to protect both parties:

• Before work commences: Full refund if you cancel before we begin design work
• After work commences but before first draft: 50% refund to cover time invested in the brief, research, and design preparation
• After the first draft is delivered: No refund. Once the initial design has been delivered for your review, the project is considered substantially performed and no refund will be issued
• After launch: No refund under any circumstances

This policy is in accordance with Australian Consumer Law. Nothing in these terms limits your rights under ACL where they cannot lawfully be excluded.

To deliver your website on time and to the highest standard, we require the following from you:

• Completion of the onboarding brief accurately and in full
• Timely responses to questions or requests for feedback (within 3 business days)
• Provision of any logos, images, or specific content you wish to include
• Confirmation that you have the legal right to use any materials you provide
• A single point of contact for feedback and approvals

Failure to provide required materials or feedback within reasonable timeframes may result in project delays or additional charges.

Upon receipt of full payment and launch of your website, you own the content and design of your site. Specifically:

• You own all written content produced for your site
• You own the visual design elements created specifically for your project
• Third-party components (frameworks, fonts, icon libraries) remain subject to their respective licences
• Mr. Website Maker retains the right to display your completed website in our portfolio unless you request otherwise in writing

Any materials you provide (logos, images, brand assets) remain your property. You warrant that you have the rights to use all materials you submit to us.

Your package includes one month of premium hosting from the date of launch. After this period:

• Hosting renewal options will be presented to you before expiry
• If hosting is not renewed, your website may be taken offline
• Domain registration and renewal (if applicable) are the client’s responsibility unless otherwise agreed
• AI assistant features may be subject to separate subscription costs depending on usage volume — this will be disclosed at the time of quoting

All packages include 30 days of post-launch support. During this period we will:

• Fix any bugs or technical issues that arise from our work
• Make minor content adjustments (text changes, image swaps)
• Assist with questions about how to use or manage your site

Support does not include new features, redesigns, or additional pages. After 30 days, ongoing support is available at agreed rates. Response to support requests is within 1 business day.

To the maximum extent permitted by law, Mr. Website Maker’s total liability to you for any claim arising from or related to the services provided shall not exceed the total amount paid by you for the specific service giving rise to the claim.

• We are not liable for any indirect, incidental, or consequential losses
• We do not guarantee specific business outcomes, traffic levels, or lead volumes from your website
• We are not responsible for third-party service interruptions (hosting providers, AI platforms, domain registrars)

These terms are governed by the laws of Australia. In the event of a dispute, both parties agree to attempt resolution in good faith before pursuing formal legal action.

• Any disputes should first be raised via email to our support address
• We aim to respond to and resolve disputes within 10 business days
• If a resolution cannot be reached, disputes may be referred to the relevant Australian consumer tribunal or court

We may update these Terms of Service from time to time. The version in effect at the time you place your order is the version that governs your engagement. We will notify existing clients of material changes via email where possible.

Continued use of our services after any update constitutes acceptance of the revised terms.
